GENERAL TERMS AND CONDITIONS OF “AGRO GROM HUNTING TOURS” AGENCY

1. Subject of the contract

In the organization of travel, the company Agro Grom (furthermore the Agency) acts as an agent between a client and a travel organizer (Reiseveranstalter / Owner of hunting business) which operates in the country of destination. The agency is authorized to arrange contracts with travellers in the name and for the account of the organizer of hunting tourism which means that as far as quality of service is concerned in the legal sense there is a link between the travel organizer and a client. By closing this contract the traveller accepts general terms and conditions of the travel organizer which are stated in the agency’s offer together with the name of the organizer. Furthermore, by closing this contract the client empowers the agency to mediate in closing and/or to close the contracts with other service providers which are necessary for a successful travel organization (airline companies, transport companies, hotel, rent-a-car, insurance etc.) as well as to mediate with carrying out business and business organization in the country of destination, departure and transit concerning immigration (visas), and export, import and transfer of weapon and ammunition and the process of export / import and transport of hunting trophies. The Agency holds the right to cost reimbursements which are the result of carrying out the above mentioned jobs and services.

2. Closing a contract

The offers which the Agency puts forward by Internet, leaflets, price lists or which are by some other means of communication delivered to a client are binding. Client's obligation is to clarify all the necessary information about the possible ambiguous details of the offer before confirming with the agency.

The contract between a client and the agency is considered to be closed:

1. when the client accepts a certain offer in writing or by some other means of communication which leaves a mark
2. when the Agency confirms the client’s spoken request in writing
3. when a client pays a part or the total amount defined in the offer

By closing this contract the client is bound not to negotiate with the travel organizer about their services if there is no agent’s authorization for that.

3. Payment

By signing a travel contract, the client takes over the obligation of paying all amounts which must be paid in accordance with the offer before the sole travel. Client is obliged to meet the deadlines and manners of payment mentioned in the offer, special agreement made during the closure of the contract and the final calculation. After the travel is agreed upon, the Agency makes a final calculation. This is made on the basis of records made by travel organizer in the country of destination and it includes all costs which Agency paid for instead of a client as well as the costs made by using travel organizer services. This calculation includes the amounts which a client paid before the date of drafting the final calculation. All amounts which a client is due to pay according to the calculation must be paid in the way and within the deadline stated in the calculation or a document which follows from it. All payments which are incurred from the closure of this contract must be paid by the traveller to the Agency and only if there is a special permission it can be paid to the travel organizer in the country of destination. All amounts which according to the calculation should be given to the client will be paid in the shortest possible time. The refund of the advance payment is guaranteed by the Agency in the contract on insurance in accordance with the Act on providing service in tourism. This refers only to the travels for which the advance payment is higher than €5,000. The amount of advance payment for the confirmation of travel reservation is defined in the offer depending on the destination of hunting tourism. On client’s request the return of the advance payment can be guaranteed by a special bank instrument.

4. Cancellation

In the case that the terms and conditions of the cancellation are precisely specified in the offer for the case when a client cancels the travel the following provisions will be valid:

If a client gives up the confirmed journey there is a possibility that another person travels instead of them, but that person should have been named as a supplementary traveller. The Agency signs a new contract with that person, but under the same terms and conditions agreed with the client who cancelled the travel. If the offer states that the advance payment serves as a guarantee of taking part in hunting, cancelling the hunting up to ninety (90) days before the commencement of travel, the client has the right to 50% of paid advance payment. If the cancellation occurs in the period shorter than ninety days before the commencement of travel the client loses the right to refund. In the case that the advance payment is not sufficient to cover the costs incurred by cancellation the client is obliged to reimburse the difference to the Agency i.e. the total amount of the costs. This especially refers to the following:

1. costs of travel cancellation in accordance with the terms and conditions of the travel organizer in the country of destination
2. costs of mediation, processing and offer acceptance
3. costs of obtaining visas, permits and licences
4. costs of mediating with other service providers
5. costs of flight cancellations, renting vehicles, hotels, guides etc

The Agency is obliged to present the costs of cancellation to a client in the form of a special account. When cancelling the hunting trips for groups, the coverage of costs which occurred by cancellation of the hunt by the whole group or individual members of the group is the responsibility of those persons who closed the contract on group hunting trip with the Agency. The Agency offers a client the possibility to contract the insurance for covering costs of the cancellation under the conditions of the insurance company. In case a client does not want to buy such insurance they must implicitly state so.

5. Changes of price and offer conditions

The Agency hold the right to change the prices in the offer in cases when the changes occurred due to the increase in the prices of transport services, government taxes, airport and harbour fees and the change in exchange rate on which the price has been based.

The Agency has the right to change other terms and conditions stated in the offer if there have been changes in the country of destination (hunting prohibition, fee increase, animal contagious disease etc.) which could not have been influenced by the travel organizer. The Agency is liable to immediately inform the passenger about the change.

6. Guarantee

The Agency does not guarantee the quality of the service provided by the organizer in the county of destination or the quality of service of other service providers which client used while travelling (transport, hotel, shipping, taxidermy etc). If it is not especially stated in the offer, the agent does not guarantee successful hunting, weight, size and quality of a trophy. The Agency does not consider agreements to be valid if a client made them with the travel organizer or some third service provider unless the Agency has received them and approved them. The Agency does not take the responsibility for the accidents which can happen to the client during the journey and the stay in the country of destination, luggage losses and damages, damages incurred by delays during the journey or damages incurred by a greater force (political unrest, infectious diseases of people or animals, natural disasters etc). The Agency does not guarantee for the damages suffered by a client due to serious oversights, neglect, unprofessionalism, or obvious intention of an agent or an employee or authorized persons. In this case, the Agency guarantees with an amount equal to triple amount of the cost of travel which does not include the value of licences, permits and carried out cull in the country of destination.

7. Complaints

The Agency holds that the provisions of this contract are valid for 30 days after the date when the contracted travel was to finish according to the agent’s knowledge. In accordance with that, this deadline is considered to be complaint period within which a client is due to deliver written complaint. The complaint can be delivered after that date if they prove that the higher force impeded them to deliver it. The travel organizers or third service providers are not authorized to receive complaints on behalf of the Agency. Considering there is objective responsibility of the Agency, travel organizer and other service providers for service quality, a client is obliged to immediately notify the Agency about the noted irregularities and ask for help to have them improved on the spot. If a client does not manage to contact the Agency or there is no reaction by travel organizer or other service providers they are obliged to record the complaint in the Records on travel, and if they do not succeed to do so they need to put together minutes which should be signed by an authorized person of the hunting organizer or an independent witness. The records must be delivered to an agent or the person authorized by an agent. The complaint does not include the requests of a client which they did not use and which were available to them but which they did not use out of many reasons (late arrival, early departure etc.)

8. Records on hunting/journey

After the end of the journey in the country of destination it is necessary to compose a Record on hunting/journey and the Agency, travel organizer and a client receive one copy each. This document is basis for the final calculation of the travel and for setting up claims from the Article 7 of this contract.

9. Cancellation of travel contract by an agent

The Agency has a right to cancel the contract and/or to terminate its carrying out if a client does not fulfil the obligations stipulated by contract and which were supposed to be fulfilled before or during the travel. In that case, the agent has the right to reimburse all costs incurred to them in the travel preparation. If the Agency cancels the travel contract due to circumstances which could not have been foreseen in the period of closing the contract and which greatly complicate or completely impede the carrying out of contracted travel, it has the right to reimburse from the client 50% of costs which it while preparing the travel and could not redeem by adequate insurance. If the Agency changes the defined travel itinerary due to unforeseen circumstances it is obliged to notify the client about that immediately upon the occurrence of such circumstances but the client does not have the right to cancel the contract.

10. Trophies

Client is obliged to respect the trophy evaluation system valid in the country of destination but can decide about taxidermy by himself. Client is obliged to inform themselves about all regulations and conditions which the import of trophy to the country depend and fulfils all forms defined by law and signs them alone or by a person they have authorized. The Agency does not guarantee that the trophies will be delivered in the country of residence. The task of the travel organizer and a client is to obtain all necessary export / import documents and to ensure that the trophies are in such conditions that there is no obstacle to their legal import. It is especially important because of additional certificates and permits for those species which are on the list Washington agreement on the protection of species defined as endangered. The Agency will provide a client with a written information about the manner of estimation of trophy quality in the country of destination, ways, possibilities and prices of taxidermy, ways and prices of the transport of such trophies as well as the information on the regulations and ways of export of trophies from the country of destination. In case a client wants the Agency to completely organize the preparation and import of trophies into the country of residence, they must draft a special agreement.

11. Hunting and other similar laws in foreign countries

Each hunter is obliged to recognize and respect the hunting regulations valid in the country they travel to. In case that a client violates these regulations the travel organizer is authorized to terminate the travel without the right of reimbursement to the client. If client hunters during no hunting season and/or against the specific guide’s order i.e. his or her absence shoot a prohibited game, they are obliged to reimburse additional fine in such occasions, besides the agreed price for game. A hunter in an individual or group hunting is obliged to respect the provisions or orders of the hunting guide concerning the manner of hunting and the safety of other participants in the hunt. All clients who do not possess valid hunting documents must possess international insurance by which they guarantee for damages which could occur during the travel. Each hunter must have passed a hunter exam and something to prove that. On that basis, The Agency will obtain hunting documents necessary for undisturbed hunting in the country of destination.

12. Weapons and ammunition

Client is obliged to inform themselves about legal provisions which are applied for hunting weapons and ammunition during the travel and while entering in the destination country and is obliged to collect all necessary documents in accordance with those provisions. The Agency will give to the passenger all necessary information regarding these issues and also offers the service of carrying out all formalities needed for the preparation of travel with their own weapon. The Agency will carry out this service with all necessary effort and attention but guarantees for the result of the procedure. By coming into effect of the contract of travel, the Agency and a client have agreed that the loss of baggage or weapons during the travel does not present the basis for the price cut or the cancellation of travel. In case of the weapon and / or luggage loss the Agency and the travel organizer are obliged to provide the client with all necessary help which includes obtaining supplementary weapons. All costs incurred during that occasion shall be covered by a client. In case a client wants to rent hunting weapons from the travel organizer in the country of destination he or she are obliged to specifically state to the Agency that they accept the terms and conditions of renting weapons and ammunitions stated in the offer. The Agency is not responsible for the quality and safety of such weapon.

13. Other

The Agency and a client will settle all disputes by agreement and in the case they fail to do so the disputes will be settled by the authorized court in the country of a client which seeks the reimbursement.
